Pre-Investment Activities
The first step taken requires us to carry out legal research and review of possible locations for real estate development- both within and outside city boundaries. Our tasks include obtaining relevant information from the relevant state and municipal authorities through registry research as well as obtaining documents from and interview with prospective sellers and business partners.
Due Diligence
Once a client has expressed interest in a location we carry out a legal due diligence of the locations and other relevant legal issues - past and present title and encumbrances registered on the property to ensure full understanding of the history and status of the location and any potential issues surrounding it. Our due diligence reports on real estate include information on urban planning and zoning status of a location, as well as the contemplated applicable development fees.
Project Planning
Our legal team works with developers, businesses and public authorities to find practical and commercial solutions to their planning needs. Project structuring includes developing the most efficient method for real estate development, tax structure, method of financing, and finally exit strategies.
Regulatory
We assist Serbian licensed construction experts in obtaining all the necessary development permits, approvals, consents and other documents from the relevant state and municipal bodies required for successful completion of the project. Furthermore, we guide clients through often cumbersome administrative procedures as efficiently as possible. Finally our services include legal assistance in planning and zoning locations.
Real Estate Project Finance
We assist in all aspects of financing real estate transactions. This includes drafting loan agreements, negotiation with borrowers, developers and other parties and drafting the necessary security documents.
Construction
We engage in negotiations with contractors, sub-contractors, agents and others on behalf of our clients. We drafting construction agreements (FIDIC based and tailor made agreements) and negotiate and draft the agreements with state and municipal utility companies.
Registration Procedures
Clearly of utmost importance is the full and formal registration of the property and its ownership. We provide a full range of services relating to all relevant registration procedures (at the relevant Land, Cadastral and other public registries).
Corporate and Contracts
In addition to the general negotiation of relations between parties involved in the real estate project, KN Real Estate is often required to facilitate creating of contractual joint ventures and handling corporate issues in real estate projects, including company establishment, as pre-development activities, as well as to negotiate and draft the lease, management and other agreements in post-development structure.
Environmental Issues
Working together with KN Environment lawyers we provide clients with advice relating to all aspects of the environment protection and in particular in the process of obtaining environmental impact assessment approval and other related issues to ensure local compliance with these regulations.
Real Estate Litigation
Occasionally real estate matters come to dispute and KN Litigation lawyers work with our team to offer clients practical and efficient dispute avoidance and resolution services in real estate projects should the need arise. Our policy is to mediate and negotiate potential conflicts but should the need arise we aggressively take cases to trial.
Tax Planning
